The '''Patent Cooperation Treaty''' ('''PCT''') is an international patent law [[treaty]], concluded in 1970. It provides a unified procedure for filing [[patent application]]s to protect [[invention]]s in each of its contracting states. A patent application filed under the PCT is called an '''international application''', or '''PCT application'''.&lt;br /&gt;

A single filing of a PCT application is made with a Receiving Office (RO) in one language. It then results in a [[prior art|search]] performed by an International Searching Authority (ISA), accompanied by a written opinion regarding the [[patentability]] of the invention, which is the subject of the application. The Washington Diplomatic Conference on the Patent Cooperation Treaty was held in [[Washington, DC|Washington]] from 25 May to 19 June 1970. The Patent Cooperation Treaty was signed on the last day of the conference on 19 June 1970. Any contracting state to the [[Paris Convention for the Protection of Industrial Property]] can become a member of the PCT.&amp;lt;ref&amp;gt;{{PCT Article|62|1}}&amp;lt;/ref&amp;gt;&lt;br /&gt;

A majority of the world's countries are parties to the PCT, including all of the major industrialised countries (with a few exceptions, including [[Argentina]], and [[Republic of China|Taiwan]]). As of 16 March 2017, there were 152 contracting states to the PCT. ==Procedure==&lt;br /&gt;
The main advantages of the PCT procedure, also referred to as the international procedure, are the possibility to maximally delay: (a) the national or regional procedures; (b) the respective fees and translation costs; and, (c) the unified filing procedure.  From a practical standpoint, this could allow new ventures more time to locate strategic partnerships, funding, and markets, before their technology becomes public.&lt;br /&gt;

===Filing===&lt;br /&gt;
The first step of the procedure consists in filing an ''international (patent) application'' with a competent patent office, called a ''Receiving Office'' (RO). This application is called an ''international application'' or simply a ''PCT application'' since it does not result in an international patent nor in a PCT patent (neither of which exists). The PCT application needs to be filed in one language only, although translations may still be required for international search and international publication, depending on the language of filing and the International Searching Authority to be used. &lt;br /&gt;

In most member states, the applicant or at least one of the applicants of the application is required to be a national or resident of the state of the receiving office where the application is filed. The ISR is published together with the PCT application (or as soon as possible afterwards). When an examination is demanded, the contracting states for which the examination is demanded are called ''Elected Offices'' (under ''Chapter II''), otherwise they are called ''Designated Offices'' (under ''Chapter I''). The ''election'' of a contracting state correspondingly means electing it when demanding (requesting) the examination.&lt;br /&gt;

An alternative to the filing of a demand for international preliminary examination is to file informal comments in response to the written opinion established by the ISA. These informal comments are not published. The PCT does not make any specific provision concerning the types of invention which may be the subject of an international application. Rules 39 and 67 permit International Searching and Preliminary Examining Authorities not to carry out search and examination on certain types of subject matter, such as scientific and mathematical theories, methods of doing business and computer programs to the extent that the Authority is not equipped to carry out a search or international preliminary examination concerning such programs. However, while a lack of international search may make national processing more difficult, {{PCT Article|27|5}} makes clear that this does not affect the issue of whether the invention is patentable under the laws of the designated States:&lt;br /&gt;

Finally, at 30 months&amp;lt;ref&amp;gt;The 30-month time limit to enter the national phase is not applicable to all countries. A small number of countries still request the entering of the national phase under Chapter I (i.e., if the preliminary examination is not demanded or not demanded in time) at 20 months. The '''Universal Copyright Convention''' ('''UCC'''), adopted in [[Geneva]], Switzerland, in 1952, is one of the two principal international conventions protecting [[copyright]]; the other is the [[Berne Convention for the Protection of Literary and Artistic Works|Berne Convention]].&lt;br /&gt;

The UCC was developed by [[UNESCO|United Nations Educational, Scientific and Cultural Organization]] (UNESCO) as an alternative to the [[Berne Convention for the Protection of Literary and Artistic Works|Berne Convention]] for those states which disagreed with aspects of the Berne Convention, but still wished to participate in some form of multilateral copyright protection. These states included developing countries as well as the United States and most of [[Latin America]]. The former thought that the strong copyright protections granted by the Berne Convention overly benefited Western, developed, copyright-exporting nations, whereas the latter two were already members of the [[Buenos Aires Convention]], a Pan-American copyright convention that was weaker than the Berne Convention. The Berne Convention states also became party to the UCC, so that their copyrights would exist in non-Berne convention states. In 1973, the [[Soviet Union]] joined the UCC.&lt;br /&gt;
&lt;br /&gt;
The United States only provided copyright protection for a fixed, renewable term, and required that in order for a work to be copyrighted it must contain a copyright notice and be registered at the [[United States Copyright Office|Copyright Office]]. The Berne Convention, on the other hand, provided for copyright protection for a single term based on the life of the [[author]], and did not require registration or the inclusion of a copyright notice for copyright to exist. Thus the United States would have to make several major modifications to [[United States copyright law|its copyright law]] in order to become a party to it.  At the time the United States was unwilling to do so. The UCC thus permits those states which had a system of protection similar to the United States for fixed terms at the time of signature to retain them. Eventually the United States became willing to participate in the Berne convention, and change its national copyright law as required. In 1989 it became a party to the Berne Convention as a result of the [[Berne Convention Implementation Act of 1988]].&lt;br /&gt;

Under the Second Protocol of the Universal Copyright Convention (Paris text), protection under U.S. copyright law is expressly required for works published by the [[United Nations]], by UN specialized agencies and by the [[Organization of American States]] (OAS).&amp;lt;ref&amp;gt;[http://uscode.house.gov/download/pls/17C1.txt House Report No. 94-1476] in connection with Title 17, [[United States Code]], Section 104&amp;lt;/ref&amp;gt; The same requirement applies to other contracting states as well.&lt;br /&gt;

Berne Convention states were concerned that the existence of the UCC would encourage parties to the Berne Convention to leave that convention and adopt the UCC instead. So the UCC included a clause stating that parties which were also Berne Convention parties need not apply the provisions of the Convention to any former Berne Convention state which renounced the Berne Convention after 1951. Thus any state which adopts the Berne Convention is penalised if it then decides to renounce it and use the UCC protections instead, since its copyrights might no longer exist in Berne Convention states.&lt;br /&gt;
&lt;br /&gt;
Since almost all countries are either members or aspiring members of the [[World Trade Organization]] (WTO), and are thus conforming to the [[Agreement on Trade-Related Aspects of Intellectual Property Rights]] Agreement (TRIPS), the UCC has lost significance.&lt;br /&gt;

The Canadian government tabled 5 treaties in the House of Commons on 27 January 2014.&amp;lt;ref&amp;gt;http://www.parl.gc.ca/HousePublications/Publication.aspx?Language=E&amp;amp;Mode=1&amp;amp;Parl=41&amp;amp;Ses=2&amp;amp;DocId=6388324&amp;lt;/ref&amp;gt;  Among the treaties is the PLT.  However, the government has not yet tabled legislation to incorporate the treaties in Canadian law, but the tabling of the treaties is a strong signal that the government is moving ahead with harmonization of its IP laws.&lt;br /&gt;
